Sailorfy Terms of Service

Welcome to Sailorfy! Please read these Terms of Service ("Terms", "Agreement") carefully before using the Sailorfy website (sailorfy.com), the Sailorfy mobile applications available on the Apple App Store and Google Play Store, and any associated services, features, or content (collectively, the "Platform" or "Services").

By creating an account, downloading the app, or accessing the Platform, you ("User", "Seafarer", "Partner", "Manager", or "You") agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.

1.Nature of Service & Operational Scope

Sailorfy is operated as a technology platform designed to streamline data management and networking within the maritime ecosystem. By using the Platform, you acknowledge and agree to the following operational boundaries:

A. Digital Credential Management Tool

Sailorfy acts primarily as a digital credential management and identity wallet for seafarers. The Platform enables seafarers to organize, store, track expiry dates, and share their professional qualifications, certifications, and sea service history.

B. Not a Recruitment or Placement Agency (Matchmaker Disclaimer)

Sailorfy is NOT a crewing agency, manning agency, Recruitment and Placement Service Licence (RPSL) holder, employer, or maritime labor broker.

Sailorfy does not recruit, place, deploy, or employ seafarers.

Sailorfy acts solely as a passive technology matchmaker and discovery platform connecting verified seafarers, manning agencies, and ship managers.

Any employment agreements, crewing contracts, or negotiations resulting from connections made on the Platform are strictly between the respective parties. Sailorfy is not a party to any contract of employment.

C. Training Aggregator Disclaimer (Not a Training Institute)

Sailorfy is a course aggregator and discovery platform, NOT a maritime training institute (MTI), academy, or course provider.

Sailorfy does not deliver STCW courses, conduct assessments, or issue maritime certifications.

Course listings, schedules, and details provided on the Platform are aggregated from third-party maritime academies and institutes.

Sailorfy assumes no liability for the quality, accreditation, execution, or cancellation of courses offered by third-party training institutes listed on the Platform.

2.Eligibility & User Accounts

Age & Qualification

You must be at least 18 years of age or the legal working age for commercial seafaring under international maritime law (including the Maritime Labour Convention - MLC 2006).

Account Integrity

You are responsible for maintaining the confidentiality of your login credentials on both the web portal and mobile applications (iOS/Android).

Accuracy of Data

You agree that all information, documents, passport details, certificates, and sea service records uploaded to your Sailorfy profile are accurate, authentic, and up-to-date. Uploading fraudulent or altered maritime documents will result in immediate termination of your account and potential reporting to maritime administrations.

3.Seafarer Data & Credential Verification

Ownership of Data

As a seafarer, you retain full ownership of your personal data, credentials, and digital profile. Sailorfy acts as the digital custodian of your data.

Third-Party Sharing

By sharing your profile via the Platform, you grant Sailorfy permission to transmit your selected credential data to authorized third parties (such as manning agencies, ship managers, training centers, or flag states) solely for the purpose of verification, compliance checks, or career matching.

Verification Disclaimer

While Sailorfy utilizes source-matching and cryptographic tools to verify document integrity, Sailorfy does not guarantee the legal validity of certificates issued by third-party flag states or institutes. Ultimate verification responsibility remains with the hiring ship manager or manning agency.

4.Mobile Application & Location Services (Safe Passage & Telemetry)

App Availability

Sailorfy provides mobile applications via the Apple App Store and Google Play Store. We do not guarantee uninterrupted or error-free app performance in low-bandwidth maritime environments.

Location & Safety Telemetry

The mobile app may offer optional location check-in, safety status updates, and transit logging features (e.g., Safe Passage modules). Active use of location services relies on device GPS, satellite data, or cellular/Wi-Fi connection.

Emergency Disclaimer

Sailorfy is a data management tool, not an emergency distress beacon (EPIRB/GMDSS substitute). In an actual emergency at sea, users must rely on official SOLAS-mandated maritime rescue channels.

5.Third-Party Links & Services

The Platform contains aggregated links to external websites, including training academies, flag state verification portals, and ship manager career sites. Sailorfy is not responsible for the content, privacy policies, or practices of any third-party websites or services.

6.Intellectual Property

All software code, visual interfaces, UI design, trademarks, logos, and algorithms associated with Sailorfy are the exclusive property of Sailorfy and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the app and portal for personal professional use (for seafarers) or internal business operations (for enterprise partners).

7.Limitation of Liability

To the maximum extent permitted by applicable law:

Sailorfy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of employment opportunities, off-hire costs, vessel detentions, or loss of revenue.

Sailorfy assumes no liability for dispute resolution between seafarers, manning agencies, shipowners, or training institutes.

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

8.Indemnification

You agree to indemnify, defend, and hold harmless Sailorfy, its founders, directors, employees, and partners from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your violation of these Terms, submission of fraudulent documents, or breach of any third-party rights.

9.Termination

Sailorfy reserves the right to suspend or terminate your account at any time, without prior notice, if you breach these Terms, submit falsified credentials, or engage in activities that compromise the integrity of the Sailorfy ecosystem.

10.Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Singapore.

11.Changes to Terms

Sailorfy reserves the right to modify these Terms at any time. Updated versions will be posted on sailorfy.com and notified via app updates. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
